Changes in the legalization of unlicensed constructions(1)

Members of the House Interior Committee are expected to make several changes to the proposals of the MPs Demetris Syllouris and Maria Kyriakou on the legalization of constructions. The issue was discussed by the Committee at an extraordinary meeting held on Monday morning, while a new meeting will take place in the afternoon.

Responding on questions made by MPs, Interior Ministry representative, Andreas Assiotis, said that according to the new legislation, the local authorities will collect and submit to a special fund the duties that will offset/redeem the breaches on buildings which are under the legalization process. The duties for the submission of the application on the final approval certificate and transfer duties will be submitted to the State Fund.

Mr. Assiotis also clarified that the costing of the amounts due will be carried out exclusively by the Land Registry and the buyer will not have the right to use private valuators.

Controversial points

Among the controversial points that are currently under discussion at the House Interior Committee meeting are:

- The regulations for the building ratio that will allow the legalization and the calculation of the square meters (government recommends a ceiling of 10%).
- Whether the activities of the three-member committee that will deal with the relevant applications will be carried out on a Cyprus basis.
- Buyers who wish to have a property deed may submit the duties and the fees for the legalization of the breaches and appeal to the court to claim their fees by the seller.
